The Competition Commission of Hong Kong announced that it has started investigation into the Hong Kong Seaport Alliance on its potential breach of competition rules.

Cosco-HIT Terminals (Hong Kong) Limited (CHT), Asia Container Terminals Limited (ACT), Hong Kong International Terminals Limited (HIT) and Modern Terminals Limited (MTL) entered into a Hong Kong Seaport Alliance to collaborate for the efficient management and operation of 23 berths across eight terminals at Kwai Tsing port, Hong Kong.

“The commission has an open investigation into the matter,” it stated.

“In particular, the commission is investigating whether the agreement may constitute a contravention of the First Conduct Rule of the Competition Ordinance by preventing, restricting or distorting competition in Hong Kong.

“The commission is carrying out this investigation as a matter of priority. The opening of a formal investigation does not prejudge its outcome,” it added.

The Hong Kong Seaport Alliance said its purpose is to improve terminal facilities competitiveness, maximise operational efficiencies, optimise utilisation of berths and reduce environmental impact.
