Wreck removal convention will come into force in April 2015

The IMO’s wreck removal convention is set to come into force on 14 April 2015 placing greater liability on the shipowner.

On Monday Denmark became the 10th state to ratify the Nairobi International Convention on the Removal Wrecks triggering it coming into force one year later on 14 April 2015.

The convention is designed to fill a gap in the existing legal framework by providing a set of uniform international rules aimed at the prompt and effective removal of wrecks located beyond a country’s territorial sea.

“Among several provisions, the convention will place financial responsibility for the removal of certain hazardous wrecks on shipowners, making insurance, or some other form of financial security, compulsory,” the IMO said.

The convention also provides the right for states to take direct actions against insurers.

The IMO noted that while the number of casualties had decreased in recent years the number of abandoned wrecks has reportedly increase.

The wreck removal convention was adopted in 2007.
